Accidental Landlord Guide

Your house didn’t sell. Rent it instead.

An accidental landlord is a homeowner who rents out a home they never meant to rent, usually because it did not sell. In 2026 that is a common position: 2.3% of U.S. rental listings were homes that had been listed for sale and did not sell, the second-highest share in Zillow’s six-year record, and in Houston it is 4.3%, triple the rate of three years ago. This page is the plan: decide with numbers, protect yourself, price it right, and hand the work to a system.

How to become a landlord when you didn’t plan to: the 30-day plan

Seven steps, in order. Each one links to the page that does the work.

  1. 1

    Decide with numbers, not nerves

Run the rent-versus-sell comparison with your mortgage, your expected rent and the price cut you would otherwise take. If renting wins by a wide margin, the rest of this plan applies.

  2. 2

Call your lender and your insurer

Most mortgages have an occupancy clause, and a homeowner policy stops covering a home you rent out. Switch to a landlord policy before the listing goes up.

  3. 3

    Price it from comparable leases

Rent is set by homes leased nearby in the last few months, not by what you need to cover. Get a comps-based range before you list.

  4. 4

    Check licenses and local rules

Montgomery and Prince George’s counties in Maryland and the District of Columbia require a rental license or basic business license before a tenant moves in. Virginia and Texas have no statewide license, though some cities (Dallas, for one) require rental registration, and HOA rules can restrict rentals anywhere.

  5. 5

    List, show and screen properly

Professional photos, MLS and rental-site syndication, coordinated showings, then screening. The Perfect 10ant System™ is our 10-point tenant screening process: identity, income, employment, credit, rental history, previous landlord references, criminal background, sex offender registry, bankruptcy and foreclosure history. Screening supports a placement decision; it does not guarantee future rent payments or eliminate every risk.

    Follow the full checklist

Eight steps in order, with what goes wrong when each one is skipped and the differences in Virginia, Maryland, DC and Texas.

  7. 7

Use a lease written for your state

Deposit caps, notice periods and required disclosures differ in Texas, Virginia, Maryland and DC. A generic template is the most common first-time landlord mistake.

  8. 8

    Know the tax clock

Selling within three years of moving out can preserve the capital-gains exclusion under the 2-out-of-5-year rule. Decide your horizon now and confirm it with a CPA.

Where you are: the numbers and the local guides

Four of the seven markets Flat Fee Landlord serves are in Zillow’s top eight for homes that failed to sell and became rentals. The DMV markets have a different trigger and different rules. Pick yours.

Houston

4.2% of rental listings were previously listed for sale (Zillow Research, data through Oct 2025); 4.3% of single-family rental listings in the Oct 2026 update, triple the rate of three years ago (Rental Housing Journal, Oct 12 2026). Single-family lease supply is up about 80% in three years and a home can take up to 60 days to lease.

Austin

4.1% of rental listings were previously listed for sale, third-highest of the large metros Zillow ranks.

San Antonio

3.9% of rental listings were previously listed for sale, fourth-highest in the Zillow ranking.

Dallas–Fort Worth

3.4% of Dallas rental listings were previously listed for sale, eighth-highest in the Zillow ranking.

Northern Virginia

Not in Zillow’s top ten. The Northern Virginia accidental landlord is usually a PCS order, a federal job change or a move, not a stalled listing.

Maryland

Not in Zillow’s top ten. Montgomery and Prince George’s County owners need a county rental license before the first tenant moves in.

Washington DC

Not in Zillow’s top ten. DC owners need a basic business license to rent, and rent-control and TOPA rules can apply when they later sell.

Monthly billing is $149, $199 and $369/mo respectively.

Placement promise

With Tenant Placement + Management, no completed application within 21 days of the home being rent-ready and listed means the first two months of management fees are waived, subject to agreement conditions. This does not guarantee a signed lease or move-in date.

FAQ

Accidental landlord questions

An accidental landlord is a homeowner who rents out a home they did not buy as an investment, usually because it did not sell, they relocated for work or military orders, or they inherited it. Zillow Research counts a listing as an accidental-landlord rental when it was listed for sale for at least two weeks, came off the market unsold, and was listed for rent within three months.
